Temporary residence permit

Permit for temporary residence for the purpose of studying

Permit for temporary residence for the purpose of studying in the first degree studies, second degree studies or uniform university master’s degree or third-degree studies is granted to a foreigner if the purpose of his stay on Polish territory is taking or continuing full-time studies or doctoral studies, hereinafter the “studies”, even when these studies are a continuation or supplement studies undertaken by the foreigner on the territory of another Member State of the European Union, and if all of the following conditions are met:

1) the foreigner shall submit:

a) the certificate from the entity offering studies about the acceptance for studies or about continuation of studies,

b) proof of payment, if the foreigner takes or continues tuition-based studies;

The foreigner must also satisfy the condition of having health insurance and sufficient funds to cover the cost of living and travel back to the country of origin or residence or transit to a third country, which grants permission to enter (see point 4.5)

The condition for granting the permit is also having sufficient funds to cover the costs of studies.

Permit for temporary residence for the purpose of studying at first degree, second degree or uniform master’s degree or third-degree studies are also granted to a foreigner who intends to take a preparatory course for studies in Polish language and meets the above conditions for granting permit for temporary residence for the purpose of studying.

In addition to general cases of refusal to grant temporary residence permit (see point 4.10), applicable to this permit, the foreigner shall be refused this permit if:

1) he has the permit for temporary residence for the purpose of studying or taking vocational training, referred to in Article 186(1) point 3(b) and is a long-term resident in another EU Member State of the EU, or

2) performs work or conducts business activities in the territory of the Republic of Poland, unless he applies for a subsequent permit for the purpose of studying.

In addition, the foreigner may be refused subsequent permit for temporary residence for the purpose of studying when he did not complete the academic year within certain time period (the time is determined by the university).

In addition to the general cases of withdrawing the temporary residence permit (see point 4.11), applicable to this permit, the authority may withdraw subsequent permit for temporary residence for the purpose of studying when the foreigner did not complete the academic year within a specified period.

The voivode notifies the rector or head of another entity offering studies, indicated by the foreigner in the application for permit, about granting the foreigner the permit for temporary residence for the purpose of studying.

Rector of the university or the head of another unit offering studies shall immediately notify in writing the voivode, who granted the permit for temporary residence for the purpose of studying, on removal of the foreigner from the list of students, as well as about failing to complete the year of studies in a specified period.

LIST OF DOCUMENTS REQUIRED WHEN APPLYING FOR A LEAVE TO REMAIN FOR A FIXED PERIOD WHEN COMING TO OR STAYING ON THE TERRITORY OF THE RP IN ORDER TO COMMENCE OR CONTINUE HIGHER EDUCATION AT A GRADUATE OR POSTGRADUATE/DOCTORAL LEVEL ON ITS TERRITORY.

IT APPLIES ALSO TO THE CASE OF COMMENCING HIGHER EDUCATION ON THE TERRITOTY OF ANOTHER EU MEMBER STATE WITH THE INTENTION TO CONTINUE IT ON THE TERRITORY OF THE RP. (art. 53 par. 1 pt.16 of the act on foreign nationals)

An application for a leave to remain for a fixed period submitted on a form, showing that the circumstances being the basis for the application justify residence on the territory of Poland for a period longer than 3 months.The application form must be completed in a legible script and substantiated in detail.
The application is submitted in 4 copies.

Four recent photographs of the applicants (each). The photographs must not be damaged; they must be in colour, size 35X45 mm, taken in the last 6 months against a uniform background, of good resolution, and showing clearly the eyes and face from the top of the head to the top part of the shoulders, so that the face takes up 70-80% of the photograph. The person must be shown with her/his head uncovered and with no dark glasses, looking straight ahead with their eyes wide open and not obscured by hair, with a natural facial expression and lips closed.

A valid travel document (passport) should be submitted for inspection, or, optionally, an officially confirmed copy of the travel document.
In exceptional circumstances when the foreign national has no valid travel document and has no possibility of obtaining it, she/he can submit another document confirming her/his identity or an officially confirmed copy of such a document.

A statement from the educational institution confirming the intention to commence or continue on the territory of the RP.
The type of such a statement is specified by a directive of the minister of higher education in agreement with the minister of internal affairs. The foreign national is obliged to submit a statement of the type specified in this directive.

A proof of payment for the commencement or continuation of education is such payment is required by the educational institution.

Documents confirming the possession of health insurance according to the regulations on national health service, or a document confirming insurance cover for the cost of medical treatment on the territory of the RP. (Health Insurance)

Documents confirming the possession of sufficient funds to cover the cost of living and return. The amount is specified by the directive of the minister of labour and social policy of 16th December 2009 concerning the minimum funds that foreign nationals commencing or continuing education and carrying out academic research should have at her/his disposal in order to cover the costs of living on the territory f the Republic of Poland and the cost of return, and documents that confirm the possibility of acquiring such funds (Statute Book 2009 no. 222 pos. 1766). The financial means should enable the foreign national to support her/himself and her/his family dependants on the territory of the RP without recourse to social benefits according to the act on social benefits of 12th March 2004.

Documents confirming that the foreign national possesses sufficient funds to cover the cost of education.

A tax clearance certificate (issued by the relevant tax office on the ZAS-W form).

A certificate confirming compliance with the obligation to register, issued by a population record body.

A receipt confirming the payment of stamp duty (340 PLN)

Xerox copies of all the pages of the travel document (passport), made in two copies.

ADDITIONAL INFORMATION

application forms must be completed in Polish
documents in a foreign language, enclosed with the application and serving as evidence in the proceedings instituted on the basis of the act on foreign nationals should be submitted with their translation into Polish, made by a sworn translator.
A foreign national staying on the territory of the RP is obliged to submit an application for a leave to remain for a fixed period at least 45 days before the expiry of the period specified in the visa or the expiry date of the previous leave to remain for a fixed period.
